Legal services for outdoor advertising companies are one of our main fields of expertise. Heading the practice, attorney Aleksander Kiel became recognised as a nationwide expert in legal services to the advertising industry by providing legal services to four of the five largest outdoor advertising companies in Poland. Our expertise:
- conducting, on behalf of an outdoor advertising company, several cases for imposing a fine for the occupation of a road lane for an advertisement without the consent of the road operator, which ended with our success, i.e. the proceedings were discontinued by the Municipal Road Authority in Poznań. The total penalties imposed on the entrepreneur exceeded PLN 2 million.
- conducting a successful case of an outdoor advertising company before the Warsaw Municipal Road Authority (ZDM) for imposing a fine for the occupation of a road lane for an advertisement without the consent of the road operator – as a result of our appeal, the Self-Government Appeal Court in Warsaw revoked the decision imposing a fine of almost PLN 600,000 on the company and discontinued the proceedings.
- representing an outdoor advertising company in an action brought by the City of Kraków for compensation for non-contractual use of real estate for advertising – dismissing the claim in 99% in the case where the claimed amount was in excess of PLN 200,000.
- carrying out due diligence on a decision to authorise the occupation of a road lane for an advertisement on behalf of an outdoor advertising company – determining an excess road lane occupation authorisation fee. As a result of our actions, the road operator reimbursed the company nearly one million zlotys in respect of wrongfully collected fees.
- representing an outdoor advertising company before tax authorities and administrative courts in cases for determining the property tax on bus shelters and advertising boards, the total liability of which exceeded PLN 2 million.
